1. Acceptance of Terms

By downloading, creating an account, or using the AI Product Photo - EcommerceSt mobile application (the “app” or “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the app.

2. Service Description

AI Product Photo - EcommerceSt allows users to enhance product photos using AI. Users can upload photos, and our Service processes them via external AI tools to generate high-quality images for ecommerce use. Specific features and usage limits depend on your subscription plan or remaining grace generations (see Section 5).

3. User Accounts

• You must verify your phone number via Firebase to access the Service.
• You are responsible for all activity under your account and for maintaining the confidentiality of the phone number used for authentication.
• You agree to notify us immediately of any unauthorized use.

4. Use of the App

You agree not to:

• Upload unlawful, harmful, or copyrighted content without permission.
• Use the app to create misleading or deceptive content.
• Reverse-engineer, copy, or resell the app or its outputs.
• Attempt to overload, disrupt, or scrape the Service.

5. Subscriptions, Billing, and Auto-Renewal

Some features of the app require an auto-renewable subscription (“Subscription”), processed through Apple App Store and Google Play Store.

5.1 Subscription Plans

Prices are displayed in your local currency on the purchase screen and may vary due to currency conversion, taxes, and store fees. The price shown in the app at the time of purchase is authoritative.

5.2 Free Trial

Each Subscription may include a 3-day free introductory trial, after which your selected plan will automatically renew at the price listed above unless cancelled at least 24 hours before the trial ends. If you have previously used a free trial for the same Subscription, you will not be eligible for another.

5.3 Auto-Renewal

• Your Subscription automatically renews at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original plan.
• You can manage or cancel your Subscription at any time through:
  • iOS: Settings > [Your Name] > Subscriptions, or https://apps.apple.com/account/subscriptions
  • Android: Google Play Store > Menu > Subscriptions, or https://play.google.com/store/account/subscriptions
• Refunds are governed by the applicable store’s refund policy (Apple App Store / Google Play Store). We do not issue direct refunds.

5.4 Usage Limits

Each Subscription includes a generation allowance per billing period (see Section 5.1). Unused generations do not roll over to the next period and reset at the start of each new billing cycle.

5.5 Grandfathered Generations

If you held a credit balance on AI Product Photo - EcommerceSt prior to the introduction of Subscriptions, those credits were converted into free grace generations on your account. These grace generations do not expire but are consumed before any Subscription quota and are not refundable.

5.6 Payment Processing

Payment is processed by Apple App Store or Google Play Store — we never receive or store your full payment instrument. By confirming a Subscription, you authorize Apple or Google to charge the applicable fees.

5.7 Changes to Subscription Terms

We may change Subscription prices or features for future billing periods. Any price change will apply only at the next renewal and will be communicated in advance. Existing Subscriptions will continue at the original price until the end of the current billing period.

6. Intellectual Property

All AI-generated images are owned by the user. However, we may retain them for up to 365 days for service delivery unless deletion is requested.

The app, code, design elements, and underlying AI models remain the property of bestphoto.studio and its licensors.

7. Third-Party Services

We use:

• OpenAI API for image generation
• Firebase for authentication
• Google Cloud for image storage
• RevenueCat for subscription management
• Apple App Store / Google Play Store for payment processing

By using the app, you consent to limited data sharing with these services. All partners are GDPR-compliant and process data securely.

8. Limitation of Liability

We do our best to provide a reliable Service, but:

• We are not liable for any business loss, data loss, or indirect damages.
• The app is provided “as is” and “as available,” with no warranty of performance or result.
• To the maximum extent permitted by law, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ends immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.
